Terms of Service

By accessing or using GrimDeck ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

GrimDeck is operated by an individual ("we," "us," or "our"). These Terms constitute a legally binding agreement between you and us.

You must be at least 18 years old to use this Service. If you are between 13 and 18 years old, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the Service, you represent and warrant that you meet these eligibility requirements.

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

GrimDeck is a Magic: The Gathering card collection and inventory management tool. The Service allows you to:

• Track your card collection with detailed condition and pricing information
• Create and manage wishlists
• Organize cards into custom binders and decks
• Search and browse Magic: The Gathering cards
• Export your collection data

Card data is provided by Scryfall. Price estimates are provided by third-party sources and are not guaranteed to be accurate.

Free Tier: Free accounts are limited to 10,000 cards in their collection. All other features are available.

Premium Subscription: Premium subscribers have no card limit. Premium subscriptions are available at $3.99 per month or $39 per year.

Payment Processing: All payments are processed by Stripe, Inc. By subscribing, you agree to Stripe's terms of service. We do not store your credit card information.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time through your account settings or the Stripe customer portal.

No Refunds: All subscription fees are non-refundable. If you cancel your subscription, you will retain access to premium features until the end of your current billing period.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Scrape, crawl, or use automated means to access the Service without our express written permission
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the Service or servers or networks connected to it
• Upload or transmit viruses, malware, or other malicious code
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service to harass, abuse, or harm others
• Circumvent any limitations on free accounts, including creating multiple accounts to exceed card limits

Magic: The Gathering: Magic: The Gathering, including card names, artwork, and game mechanics, is owned by Wizards of the Coast LLC. GrimDeck displays unofficial fan content under the Wizards of the Coast Fan Content Policy. GrimDeck is not affiliated with or endorsed by Wizards of the Coast.

Your Content: You retain ownership of any content you create on the Service, such as collection notes and binder descriptions. By using the Service, you grant us a limited license to store and display this content as necessary to provide the Service.

GrimDeck: The GrimDeck name, logo, and original software code are our property and may not be used without permission.

By You: You may delete your account at any time through your account settings. Upon deletion, all your data will be permanently removed from our systems.

By Us: We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. We will make reasonable efforts to notify you before termination when possible.

Upon termination, your right to use the Service will immediately cease. We are not liable for any loss of data resulting from account termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. Price estimates and card data are provided for informational purposes only and may not be accurate.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or your data
• Any errors or omissions in the Service or any content
• Any third-party conduct or content on the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless GrimDeck and its operator from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Texas, and the arbitrator's decision shall be final and binding.

Class Action Waiver: YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may bring an individual action in small claims court for disputes within the court's jurisdiction. Either party may seek injunctive relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and us regarding the Service.
